Confidentiality Policy
Effective Date: 1st January 2026.
GetComply India Private Limited (“GetComply”, “we”, “our”, “us”) is committed to maintaining the confidentiality of all information shared by clients during the course of providing consultancy and compliance services.
1. Scope of Confidential Information
Confidential information includes, but is not limited to:
- Personal details of clients and representatives
- Business information, operational details, and financial data
- Documents submitted for FSSAI licensing, registration, renewal, or compliance
- Login credentials, authorization letters, declarations, and forms
- Communication exchanged via email, WhatsApp, phone calls, or portals
2. Use of Confidential Information
Confidential information shared with GetComply shall be used solely for the purpose of providing consultancy, documentation assistance, application filing, and regulatory compliance support.
We do not use client data for any purpose unrelated to service delivery.
3. Disclosure of Information
Confidential information may be disclosed only when required:
- To government authorities such as FSSAI through official portals.
- To authorized third parties (laboratories, auditors, service partners) strictly for compliance purposes.
- When required by law, court order, or regulatory authority.
Such disclosures are limited to the minimum information necessary.
4. Data Protection & Security
GetComply implements reasonable administrative, technical, and organizational measures to safeguard confidential information against unauthorized access, disclosure, alteration, or misuse.
However, clients acknowledge that no digital transmission or storage system is completely secure.
5. Client Responsibility
Clients are responsible for:
- Providing accurate and lawful information
- Ensuring documents shared are genuine and authorized
- Protecting access credentials shared with GetComply
GetComply shall not be responsible for confidentiality breaches caused by client negligence, third-party actions, or cyber incidents beyond reasonable control.
6. Retention of Information
Confidential information may be retained for:
- Legal and regulatory compliance
- Record-keeping and audit purposes
- Dispute resolution
Information will not be retained longer than necessary unless required by law.
7. No Liability for Misuse by Clients
GetComply shall not be liable for any misuse, disclosure, or illegal use of confidential information by clients, their employees, associates, or third parties after service delivery or license issuance.
8. Survival of Confidentiality
This confidentiality obligation shall survive the termination or completion of services between the client and GetComply.
9. Governing Law & Jurisdiction
This Confidentiality Policy shall be governed by and construed in accordance with the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
